Glamis Gold Reports Favorable Decision on Marigold Appeal.

") has issued a decision rejecting a requested stay of the Marigold marigold, any plant of the genus Tagetes of the family Asteraceae (aster family), mostly Central and South American herbs cultivated elsewhere as garden flowers. The two common species of marigold, both annuals, are distinguished as African, or Aztec (T.  Mine expansion. The appellant, Western Exploration Inc., had requested the cessation of activities associated with the expansion during the period in which its appeal of the Record of Decision approving the Marigold expansion was pending. In rejecting the stay request, the IBLA specifically found that the appellant had failed to show a reasonable probability of succeeding on the merits on the merits adj. referring to a judgment, decision or ruling of a court based upon the facts presented in evidence and the law applied to that evidence. A judge decides a case "on the merits" when he/she bases the decision on the fundamental issues and considers  of its appeal. While the appeal itself remains pending, Glamis is proceeding with work on the Marigold expansion as planned.
