GRACE CONFIRMS LEGAL ACTION AGAINST FLEMISH GOVERNMENT IN BELGIUM

 BOCA RATON, Fla., Jan. 19 /PRNewswire/ -- W. R. Grace & Co. (NYSE: GRA) today confirmed that subsidiaries have initiated legal action against the Flemish government in Belgium related to the forced closure of its silica plant in Puurs. The closure was reflected in a one-time charge of $140 million after taxes, which Grace was forced to record in last year's third quarter. Grace is seeking in excess of four billion Belgian francs (approximately $120 million U.S. at current exchange rates) plus interest and loss of profits.
 A by-product disposal permit previously issued to a supplier to and taker of critical products from the Grace plant was revoked by the Flemish government, resulting in the permanent closure of the supplier's plant. The revocation of the permit caused the Grace plant to become economically impossible to operate. Through this litigation Grace is attempting to recover its loss resulting from the forced closure of the plant.
 The closed plant produced fumed silica through a new proprietary pyrogenic process and was still in start-up at the time of closure.
