GENTEX SEEKS PRELIMINARY INJUNCTION BARRING DONNELLY
FROM SELLING AND MARKETING ELECTROCHROMIC MIRRORS
ZEELAND, Mich., Sept. 3 /PRNewswire/ -- Gentex Corporation (NASDAQ-NMS: GNTX) announced today that it has made a motion seeking a preliminary injunction against Donnelly Corporation (AMEX: DON), to order it to cease its selling and marketing activities in the United States associated with Donnelly's electrochromic, automatic-dimming mirrors. The company has requested that the court order Donnelly to terminate these and related activities until the lawsuit Gentex filed on Aug. 5, 1992, alleging that Donnelly's electrochromic, automatic-dimming mirrors infringe Gentex's U.S. Patent No. 5,128,799, is resolved.
"We believe that Donnelly's price-cutting activities are damaging Gentex in the marketplace for future model years. We have no choice but to seek relief by requesting an order barring Donnelly from continuing those activities until we can resolve the dispute on the new Gentex patent issued July 7, 1992, for a 'Variable Reflectance Motor Vehicle Mirror,'" said Gentex Executive Vice President Kenneth LaGrand.
The lawsuit alleging infringement of U.S. Patent No. 5,128,799 granted to Gentex on July 7, 1992, is a separate civil action from the one which Gentex initiated against Donnelly on May 10, 1990. That earlier lawsuit is scheduled for trial of certain issues on Sept. 8, 1992, in the Federal District Court in Grand Rapids, Mich.
Gentex Corporation develops, manufactures and markets proprietary electro-optical products: patented automatic-dimming Interior and Exterior Night Vision Safety(TM) (NVS(TM)) Mirrors for the worldwide motor vehicle industry, and an extensive line of fire protection products for commercial applications.
Gentex was the first company in the world to produce a commercial electrochromic NVS Mirror for the motor vehicle industry, and is the leading supplier of NVS Mirrors to the worldwide automotive industry.
