GATCH RESIGNATION ACCEPTED BY T.O.

THOUSAND OAKS Thousand Oaks, residential city (1990 pop. 104,352), Ventura co., S Calif., in a farm area; inc. 1964. Avocados, citrus, vegetables, strawberries, and nursery products are grown.  - A divided City Council has accepted the resignation of City Manager Phil Gatch, who said he was ending his 38-year career at the urging of one of the council members.

Assistant City Manager Scott Mitnick will take over as the interim city manager until a successor is found. Gatch, 64, will leave his post May 6.

The City Council also voted late Tuesday for a contract termination Defense procurement: the cessation or cancellation, in whole or in part, of work under a prime contract or a subcontract thereunder for the convenience of, or at the option of, the government, or due to failure of the contractor to perform in accordance with the terms of the contract (default).  agreement that gives Gatch more than $490,000 in salary and accrued ac·crue

Fox, who voted along with council members Dennis Gillette and Jacqui Irwin to accept the resignation, could not be reached for comment. Fox was mayor in 2003, when he opposed Gatch's appointment as city manager.

``It's just unfortunate it had to end this way, given the controversial surroundings of the whole matter,'' said Mayor Claudia Bill-de la Pena, a Gatch supporter who said he served as the guardian for the city's development standards for years.

Councilman Ed Masry voted with Bill-de la Pena to oppose the resignation.

Gatch said he knew of no particular objection A formal attestation or declaration of disapproval concerning a specific point of law or procedure during the course of a trial; a statement indicating disagreement with a judge's ruling.  the council majority had to his staying on the job of running the city of 130,000 people.

Controversy over how the Gatch resignation was handled led the full City Council last week to request an investigation by the Ventura County District Attorney's CERTIFICATE, ATTORNEY'S, Practice, English law. By statute 37 Geo. III., c. 90, s. 26, 28, attorneys are required to deliver to the commissioners of stamp duties, a paper or note in writing, containing the name and usual place of residence of such person, and thereupon, on paying certain  Office into possible violations of the state's Brown Act open-meeting law. So far the D.A.'s Office has not decided whether to look into the matter.
