An individual convicted of a sexual offense challenged the constitutionality of the Michigan Sex Offenders Registration Act (SORA). The federal district court held that the public notification provisions of SORA violated vi·o·late tr.v. vi·o·lat·ed, vi·o·lat·ing, vi·o·lates 1. To break or disregard (a law or promise, for example). 2. To assault (a person) sexually. 3. procedural due process. The court found that SORA provided no opportunity to be heard on whether, and to what extent, public notification of a sex offender's registry information was necessary to protect the public, and the extent to which registration requirements could burden sex offenders, when balanced against the need to protect the public. The court found that the reputation damage to an individual convicted of a sexual offense resulting from registration as a sex offender pursuant to the Act, coupled with the ongoing legal obligations of registration and the corresponding criminal penalties for failure to fulfill the obligations of registration, met the "stigma stigma: see pistil.
