Fish & Richardson Attorneys reach settlement for Veeco Instruments.

Coronado is across the bay.  office of Fish & Richardson PC reached a settlement last week for a client involved in a rare nanotechnology patent dispute.

Publicly traded Veeco Instruments Inc., a leading maker of atomic force microscopes atomic force microscope (AFM), device that uses a spring-mounted probe to image individual atoms on the surface of a material. Unlike the scanning tunneling microscope, which is also a scanning probe microscope, the AFM can be used on materials that do not conduct , brought suit against employee-owned Asylum Research Corp., formed by former Veeco employees, in 2003 alleging that Santa Barbara-based Asylum infringed on its patents involved in the manufacture, use and sale of its MFP-3D microscopes.

Fish & Richardson attorneys representing Asylum said they had settled the case Aug. 11. Under terms of the settlement, Asylum and Veeco agreed to drop all pending claims against each other and agreed to a five-year, worldwide cross license of each other's patents and a mutual covenant not to sue COVENANT NOT TO SUE. This is a covenant entered into by a party who had a cause of action at the time of making it, and by which he agrees not to sue the party liable to such action.
