It's outlawed under the Telephone Consumer Protection Act of 1991 and Federal Communication Commission (FCC (1) (Federal Communications Commission, Washington, DC, www.fcc.gov) The U.S. government agency that regulates interstate and international communications including wire, cable, radio, TV and satellite. The FCC was created under the U.S. ) rules. First, they must obtain express written consent.

But there's been an exemption, and the FCC has extended it until Jan. 1, 2005. If businesses can prove that they have an "established" relationship with the recipient, they can fax unsolicited advertisements. Courts, however, are divided on the definition of an "established business relationship."

But at least 13 legislatures have imposed additional restrictions on fax advertising. In Colorado, for example, starting Aug. 4, anyone receiving a junk fax Junk faxes are a form of telemarketing where unsolicited advertisements are sent via fax transmission. Junk faxes are the faxed equivalent of spam or junk mail. Proponents of this advertising medium often use the terms broadcast fax or fax advertising  can pursue civil remedies CIVIL REMEDY, practice. This term is used in opposition to the remedy given by indictment in a criminal case, and signifies the remedy which the law gives to the party against the offender.
