The foundation, which was formed in 1993, sent copies of its tax returns for 1997 and 1998, and will send 1999's when foundation accountants complete that year's tax return. The Internal Revenue Service has given the foundation until Aug. 15 to file the 1999 return, Ward said.

No information was submitted for the years 1993 through 1996 because there was little financial activity, Ward said.

But state officials noted in the 1997 return a beginning balance of $5,936 that was carried over from the previous year, Toole said.

``In looking at the report for 1997, there was a beginning balance, indicating activity in 1996,'' Toole said. ``We have to contact them and ask them for information from 1996.''

Toole said her office also will ask the foundation for a copy of the request for the extension on the 1999 filing.

``They still need to tie up these loose ends,'' Toole said. ``Until we contact them, (the foundation) is not really current and not really delinquent either.''

Ward said the foundation will provide the state with information about what financial activity took place in 1996.

``The only other issue is 1996 and whether or not there was actual activity in 1996. We believe there was nothing reportable,'' Ward said.

Toole said her office leaves the responsibility of filing required financial reports to the organizations themselves.
