FOODMAKER FILES SUIT AGAINST MEAT SUPPLIERS

 SAN DIEGO, Feb. 4 /PRNewswire/ -- Foodmaker Inc. (NYSE: FM), operator and franchisor of the JACK IN THE BOX restaurant chain, announced today that it has filed a comprehensive action against The Vons Companies Inc. and other suppliers in connection with food-borne illnesses in the northwest United States.
 The complaint, filed today in Superior Court of the State of California, County of San Diego, seeks full recovery of all losses and damage sustained or to be sustained by Foodmaker as a result of these events. It further seeks full indemnity from the claims that have and will be filed as a result of this situation. The action also charges the defendants with strict liability, breach of expressed and implied warranties, negligence, negligent interference with business relationships, negligent misrepresentations and seeks declaratory relief.
 "Foodmaker, which has a long-standing tradition for serving high quality food to the public, was devastated by this tragic outbreak," said Michael Thorsnes of Thorsnes Bartolotta McGuire & Padilla, the San Diego-based law firm retained by Foodmaker to handle the suit.
 "Foodmaker has taken a number of bold and immediate steps to ensure that its products are safe and wholesome, including appointment of new meat suppliers," said Thorsnes.
 The suit does not define a specific monetary amount for damages.
