FEDERAL COURT RULES EASY EGGS PATENTS VALID

MINNEAPOLIS, July 14 /PRNewswire/ -- Michael Foods, Inc. (NASDAQ-NMS: MIKL) said today it was granted summary judgment that the patents it licenses pertaining to the ultrapasteurization of liquid eggs -- Easy Eggs(R) -- are valid and enforceable. The ruling results from a motion brought by Michael Foods and North Carolina State University (NCSU), the patent holder, in the United States District Court for the District of New Jersey as a part of their litigation against Papetti's Hygrade Egg Products, Inc. (Papetti's).
In November 1992 the court found that Papetti's had infringed the claims of the NCSU patents. In this patent validity ruling, the court commented, "Papetti's alleged, earlier in this litigation, that the patents in suit were invalid .... It has never put any meat, either through argument or the identification of any supporting evidence, on the bare bones of this allegation ...."
The remaining issue before the court in this matter is the amount of damages due Michael Foods and NCSU from Papetti's illegal activity.
Richard G. Olson, president and CEO of Michael Foods, commented, "We are gratified that the court has upheld our position. Our stockholders have been significantly damaged by Papetti's actions. We look forward to determination of damages by the court for this infringement."
