F&E RESOURCE SYSTEMS TECHNOLOGY AND P.G. FERST LIMITED PARTNERSHIP FILE SUIT AGAINST BROWNING-FERRIS INDUSTRIES

BALTIMORE, Jan. 4 /PRNewswire/ -- F&E Resource Systems Technology Inc. (FERST) (NASDAQ: FERS) and P.G. FERST Limited Partnership announced today that they have filed suit against Browning-Ferris Industries Inc. (NYSE: BFI) and its wholly owned subsidiary Browning-Ferris Inc. seeking compensatory damages of $100 million, punitive damages of $200 million and claims from all counts totaling $1.3 billion. The claims asserted in the suit include breach of contract, fraudulent misrepresentation, tortuous interference with contractual relations and antitrust violations, relating to BFI's withdrawal from its commitment to supply waste to FERST's project in Prince George's County, Md.
The lawsuit arose from BFI's withdrawal as the sole supplier of municipal solid waste from FERST's proposed recycling and composting facility in Prince George's County.
Ron Pickett, chairman and CEO of FERST, stated: "We have been abused by BFI in its attempt to drive us from the market and capture it for themselves. I believe BFI's record shows that this is not new ground for them. However, we are standing up to this giant for our company, its shareholders and the community. We will see this to its conclusion."
FERST, headquartered in Maryland, is an owner and operator of recycling and composting facilities. The company is traded on NASDAQ under the symbol "FERS."
