Estevez-Yalcin v. Children's Village.

Estevez-Yalcin v. Children's Village, 331 F.Supp.2d 170 (S.D.N.Y. 2004). A parent brought an action alleging that her children had been sexually abused by a volunteer at a county juvenile treatment rehabilitation center. The district court granted summary judgment in favor of the defendants. The court held that the county did not negligently hire the volunteer or negligently retain or supervise the volunteer. According to the court, the failure of the county to conduct a background check on the volunteer before hiring him did not amount to negligent hiring, absent evidence that a routine background check would have revealed that the volunteer had a propensity to harm children.
