IMPARTIALITY

Espinal v. Goord, 180 F.Supp.2d 532 (S.D.N.Y. 2002). A state inmate INMATE. One who dwells in a part of another's house, the latter dwelling, at the same time, in the said house. Kitch. 45, b; Com. R. 154; 2 Man. & Ry. 227; 9 B. & Cr.  filed a [section] 1983 action against prison official alleging violation of his Eighth and Fourteenth Amendment Fourteenth Amendment, addition to the U.S. Constitution, adopted 1868. The amendment comprises five sections. Section 1


Section 1 of the amendment declares that all persons born or naturalized in the United States are American citizens and citizens
 rights. The district court denied the inmate's motion that asked the court to order him released from punitive segregation. The court found that the inmate received adequate notice of the disciplinary charges against him and that the hearing officer was sufficiently fair and impartial. The inmate had asserted that the misbehavior report that notified him of the charges against him should have indicated the basis of knowledge or veracity veracity (vras´itē),

 of confidential informants who provided information, but the court held that such information was not necessary to apprize the inmate of the nature of the charges against him. The court also found that the hearing officer was not rendered insufficiently fair and impartial because he was the supervisor of the security staff who responded to the incident.
