Enzo's Infringement Suit Against Five Defendants to Proceed Before

In yesterday's decision, they granted Enzo's petition for rehearing, vacated the prior decision and reversed the district court's grant of summary judgment that Enzo's claims are invalid for failure to meet the written description requirement. Citing genuine issues of material fact that exist regarding satisfaction of the written description requirement, the case was returned for further proceedings before the trial court. No trial was ever held.
