Eminent domain.


Regarding "The Real Problem with Kelo" (July 25 issue), the Fifth Amendment of the Constitution of the United States Constitution of the United States, document embodying the fundamental principles upon which the American republic is conducted. Drawn up at the Constitutional Convention in Philadelphia in 1787, the Constitution was signed on Sept.  provides in part: "... nor shall private property be taken for public use without just compensation." The private property in the Kelo case was not taken for public use; it was taken for private use.

Even if the Supreme Court had the constitutional authority to make a ruling in this case (which it doesn't), the United States Supreme Court United States Supreme Court: see Supreme Court, United States.  decision in the subject case is not in conformity with the Fifth Amendment, and is in error.

Also, the Fourth Amendment of the Constitution of the United States provides in part: "The right of the people to be secure in their ... houses ... against unreasonable ... seizures, shall not be violated."

The Kelo decision, therefore, does not conform to Verb 1. conform to - satisfy a condition or restriction; "Does this paper meet the requirements for the degree?"

coordinate - be co-ordinated; "These activities coordinate well"
 the Fourth Amendment, and is in error.

It is the responsibility of the Executive Branch and the Legislative Branch of the federal government to take purposeful and vigorous action against the Supreme Court in the subject case to render said decision null and void.

A strong stance by the federal government could set precedents for the Eminent Domain eminent domain, the right of a government to force the owner of private property sell it if it is needed for a public use. The right is based on the doctrine that a sovereign state has dominion over all lands and buildings within its borders, which has its origins in  issue for future federal government actions, for the 50 states of the United States United States, officially United States of America, republic (2005 est. pop. 295,734,000), 3,539,227 sq mi (9,166,598 sq km), North America. The United States is the world's third largest country in population and the fourth largest country in area. , and all the municipalities in America.
