The FCC was created under the U.S. late last year against Cablevision subsidiary Rainbow Programming Holdings, alleging that Cablevision has failed to provide EchoStar with regional sports programming on the non-discriminatory terms required by legislation like the Cable Act of 1992. EchoStar claimed that a pattern of discrimination and delay on Cablevision's part has essentially denied EchoStar access to sports programming that would allow it to compete effectively against the cable companies. Bones of contention include alleged attempts to tie access to certain channels with access to other channels; programming prices that are allegedly higher than those offered to cable companies; and penetration and programming package requirements and tiering restrictions that are allegedly more severe than those imposed on cable companies.
