Earthworks Achieves Major Milestone With Respect to Advancement of California Waste Handling Project.

VANCOUVER, British Columbia--(BUSINESS WIRE)--Feb. 4, 2004

Earthworks Industries Inc. ("Company") is pleased to announce that, in furtherance of the development of plans for its Colusa County, California Colusa County is a county located in the Central Valley of the U.S. state of California, northwest of state capital Sacramento. As of 2000, the population was 18,804. The county seat is Colusa.  waste management project, a preliminary agreement has been signed between the Company's wholly owned subsidiary Wholly Owned Subsidiary

, Cortina Integrated Waste Management, Inc Waste Management, Inc. (NYSE: WMI) is a waste management, comprehensive waste, and environmental services company in North America. The company's network includes 413 collection operations, 370 transfer stations, 283 active landfill disposal sites, 17 waste-to-energy plants, . ("CIWM"), the Cortina Indian Band ("Band") and Colusa County. The agreement establishes a framework for cooperation with the County and recites the approval by the U.S. Bureau of Indian Affairs The Bureau of Indian Affairs (BIA) is an agency of the federal government of the United States within the Department of the Interior charged with the administration and management of 55.7 million acres (87,000 sq.  of the Lease granted by the Band to CIWM of the land on which the project is to be built.

The agreement provides that the County, the Band and CIWM will proceed with the negotiation of a further agreement to settle all outstanding issues. It also requires the Company to finance a review, which will conform with the California Environmental Quality Act The California Environmental Quality Act (CEQA) is a California law (California Public Resources Code section 21000 et seq.) passed in 1970, shortly after the Federal Government passed the National Environmental Policy Act. , of off-site environmental impacts relating to the roadway intersections and improvements that may be required as a result of the truck traffic that the project will generate. The review will be done within the framework of CIWM's project development schedule. The agreement acknowledges that when the further agreement is successfully negotiated and signed the County's court litigation - which was started and then stayed - will be formally terminated.
