EX ARCADE PRESIDENT BARRED FROM SOLICITING FORMER CUSTOMERS

 ATLANTA, March 30 /PRNewswire/ -- Former Arcade Building Maintenance, Inc., President, Robert J. Ward, Monday, lost his bid in a Manhattan appellate court to solicit Arcade customers or use the company's confidential customer information.
 The court ruled that use of such information by Ward, now group president of a division of rival contracting company, ISS International Service Systems, would give him an unfair opportunity and advantage over competitors who do not have access to such information.
 Ward served as Arcade president for 21 years before leaving the company in June of 1992 when his contract expired.
 When Arcade was purchased by BET PLC in 1989, Ward entered into an employment contract with restrictive covenants prohibiting him from working for a competing company or disclosing confidential information about Arcade. After leaving Arcade however, Ward petitioned the New York Supreme Court to declare the restrictive covenants void. The trial court ruled that while Ward could be employed by ISS, he could not use certain confidential information, including customer names.
 "The appellate court's decision affirms the validity of those restrictions," said Arcade Attorney Charles K. O'Neill, a partner with Chadbourne & Parke.
 "This decision fully vindicates Arcade. Mr. Ward signed an agreement with Arcade for which he was handsomely compensated. His attempt to have a court sanction his solicitation of Arcade's customers and use of company confidential information in violation of his agreement, has rightfully been rejected by not only the trial judge, but by the five appellate justices who heard the appeal."
