Drinking leads to shooting.


Shortly after 6 a.m. on June 9, 2002, police in Plattsburgh, New York New York, state, United States

, responded to a 911 burglary call and found Andrew Leroux lying dead on a sidewalk near the residence of Mr. and Mrs. Lawrence Crouthers. Leroux had been shot once in the chest by Mr. Crouthers, who believed that Leroux had been attempting to break into his home. Leroux, a college student, had reportedly been drinking heavily during a party, had left, and may have mistakenly thought he was returning to the party when he stumbled onto the Crouthers' porch.

Prosecutors submitted the case to a grand jury. Following four days of testimony from 17 witnesses, jurors ruled on July 29, 2002, that Crouthers had shot Leroux in self-defense (Law) in protection of self, - it being permitted in law to a party on whom a grave wrong is attempted to resist the wrong, even at the peril of the life of the assailiant.

 subsequently ordered county District Attorney Richard Cantwell to re-present the case to a grand jury with the lesser charges of manslaughter and criminally negligent homicide.
