Live, however, was momentarily distracted by the gunshot. Blume grabbed him and the two began struggling for control of Live's 9mm pistol. Live was also carrying a .38-caliber firearm firearm, device consisting essentially of a straight tube to propel shot, shell, or bullets by the explosion of gunpowder. Although the Chinese discovered gunpowder as early as the 9th cent., they did not develop firearms until the mid-14th cent. . Blume gained control of the .38-caliber handgun and shot Live. Both thugs were dead by the time police arrived. Bonder sustained a minor hand injury, but was otherwise unharmed. Blume suffered painful bruises during his tussle with Live, and told the December 12 New York Newsday, "My face hurts all over."

Live had a lengthy criminal record that included 10 arrests since 1973 and convictions for selling drugs, assault, robbery, criminal possession of a weapon, grand larceny A category of larceny—the offense of illegally taking the property of another—in which the value of the property taken is greater than that set for petit larceny.

At Common Law, the punishment for grand larceny was death.

On December 11, the Brooklyn district attorney's office announced that no charges would be filed against Blume, and called the incident "a justified shooting." Investigators had initially speculated that the unlicensed .38-caliber gun Blume used to shoot the robbers may have belonged to the shop owner. If this were the case, Blume could have been prosecuted under New York's burdensome gun control statutes, but the district attorney's office stated, "We have no indication that [Blume] illegally possessed a gun."
