DexCom finds itself as the focus of Abbott Diabetes Inc. lawsuit.


San Diego-based DexCom, which develops glucose monitoring glucose monitoring Lab medicine The periodic evaluation of any analyte abnormal in Pts with DM, to assess short and long-term control with antiglycemic agents. See Glucose, Glycated hemoglobin.  systems for diabetes patients, defended itself last week as it announced Illinois-based Abbott Diabetes Care, Inc. had filed a lawsuit alleging patent infringement patent infringement n. the manufacture and/or use of an invention or improvement for which someone else owns a patent issued by the government, without obtaining permission of the owner of the patent by contract, license or waiver. .

Abbott's complaint was filed in the U.S. District Court in Delaware and alleges patent infringement against DexCom's STS (Synchronous Transport Signal) The electrical equivalent of the SONET optical signal. In SDH, the European counterpart of SONET, STS is known as STM (Synchronous Transport Module).  Continuous Glucose Monitoring System.

DexCom, which went public in April, discredited the claim in a written statement, saying Abbott would have no way of knowing details about DexCom's product because it has been in clinical trials and unavailable to Abbott for examination.

"DexCom is not harming Abbott's current glucose monitoring business in any manner," the statement read.

DexCom does not have Food and Drug Administration approval for its product, which lets diabetics monitor their blood sugar without daily finger-pricks.

The company has 62 pending U.S. applications for patents for medical devices and seven approved.

Abbott filed for approval of a continuous glucose monitoring system about a year and a half before DexCom.
