QUALIFIED IMMUNITY Qualified immunity is a doctrine in United States law providing immunity from suit to government officials performing discretionary functions when their action did not violate clearly established law. Qualified immunity was created by the U.S.  

Davis v. Hall, 375 F.3d 703 (8th Cir. 2004). A former state inmate brought a [section] 1983 action against prison officials, alleging due process violations in connection with his prolonged incarceration Confinement in a jail or prison; imprisonment.

The appeals court held that prison officials who failed to release the inmate for 57 days after a judge ordered the release deprived him of his Fourteenth Amendment Fourteenth Amendment, addition to the U.S. Constitution, adopted 1868. The amendment comprises five sections. Section 1


Section 1 of the amendment declares that all persons born or naturalized in the United States are American citizens and citizens
