Daily News owner hit with Big damage award in vendor's suit. Singleton's Denver-based MediaNews Group Not to be confused with Media General, an unrelated newspaper and TV group. MediaNews Group, based in Denver, Colorado, is one of the largest newspaper companies in the United States. Inc., which also owns the Long Beach Press Telegram, the San Gabriel Valley The San Gabriel Valley is one of the principal valleys of southern California. It lies to the east of the city of Los Angeles, to the north of the Puente Hills, to the south of the San Gabriel Mountains, and to the west of the Inland Empire. Newspaper Group and the Inland Valley California's Inland Valley is a region that inlcudes parts of San Bernadino, and Riverside counties. As the name implies, the Inland Valley is situated on the inland side of the Santa Ana Mountains in southern California. There are few geographic boundaries to define the area. Daily Bulletin, had stopped paying for newsprint from the mill because it claimed the price per metric ton should have included a "Big Buyer" discount. LLC - Logical Link Control , owner of the newsprint mill and a subsidiary of Dublin, Ireland-based Jefferson Smurfit Group Plc, sued MediaNews in November 2001 for breach of contract, unpaid invoices and damages. MediaNews paid $2.4 million in unpaid invoices after the suit was filed, but the case went ahead when SPC/Pomona sought damages. It won that round when a jury tacked on another $2.7 million last month. "They paid us after we sued them, but by that time we were incurring damages," said Steven Gardner, a partner at Berkowitz & Black in Beverly Hills Beverly Hills, city (1990 pop. 31,971), Los Angeles co., S Calif., completely surrounded by the city of Los Angeles; inc. 1914. The largely residential city is home to many motion-picture and television personalities. who represents SPC/Pomona. Theresa Kristovich, a partner at Hughes Hubbard & Reed LLP LLP - Lower Layer Protocol representing MediaNews, said she plans to ask for a new trial based on evidence excluded from the recent case. According to court documents, SPC/Pomona started providing newsprint to MediaNews in 1996. In September or October 2000, executives from both companies re-negotiated the per-ton price of the contract. At the time of the new contract, which began on Jan. 1, 2001 and was to end on Dec. 31, 2002, the price was $605 per metric ton. According to SPC/Pomona's complaint, MediaNews failed to pay invoices from January through July 2001, when it stopped ordering from SPC/Pomona. MediaNews, in its trial brief, claims it should have received a "Big Buyer" discount of $20 to $30 per metric ton below the index price and that the price should have been negotiable under a clause in the contract for "adverse business conditions," which includes reduced advertising revenue, according to MediaNews' trial brief. |
