DP Money: QUESTIONS of CASH.Byline: TONY HETHERINGTON I MARRIED in 1959 and we had two children, but my husband was not a good family man. The children grew up and moved down South, and I left my husband in 1993. We were divorced in 1994. My ex-husband died in April. His solicitor gave my s. ..and daughter a copy of their father's will, made a week after we divorced. Everything was left to his brother. Our children, and their children, received nothing. Do my children have any chance of getting a share if they contest the will? Mrs D.G.,Northwich DEPENDENTS who are left out of a will can make a claim. However, the rather sad picture you paint seems to show that your children, who now have children of their own, could not be described as dependent on their father. Another possibility might be to challenge the will, if you believe it was made under duress duress (dy `rĭs, d `–, d ,or your ex-husband was not mentally
capable of making it. But you would need evidence for this.
Please do not let me discourage your children from seeking legal advice, but the unpleasant truth may well be that your ex husband regarded himself as divorced from them just as much as from you,and showed this when he cut them out of his will. AFTER I retired I was asked by an organisation to give occasional talks, for which I receive only expenses. Would there be any tax liability on these small amounts? D.J.,Wrexham IF YOU really are receiving nothing more than genuine expenses to cover such things as travel costs, you are not making a profit and there cannot be a tax bill. You do not seem to be giving talks as a business, in which case you would have to submit accounts to your tax inspector even if you made a loss. It is very unlikely that you will ever be asked to prove that you are not out to make a profit, but to play safe, keep a note of how much you receive and how much you spend. THANK you for the recent explanation about the tighter rules for getting Goldfish card spending points. I am on a low income and the occasional pounds 10 vouchers kept me in skin cream! Do you have any suggestions for other credit cards with good points schemes, please? R.M.M.,Wallasey THE Goldfish scheme still ranks as one of the better points plans. Even after the cuts, spending pounds 1,000 on your Goldfish card will earn you an pounds 8 Marks & Spencer voucher A receipt or release which provides evidence of payment or other discharge of a debt, often for purposes of reimbursement, or attests to the accuracy of the accounts. . But the simplest, and probably best, reward schemes have to be the pure cash back offers. Cashback cards usually offer a flat half a per cent, so a pounds 100 shopping trip earns you just 50p. But the American Express Blue card (0800-700111)and the Capital One Bank's Circle Rebate rebate, partial refund of the total price paid for goods or services. In the United States, rebates were historically given by railroads to favored shippers as a return on transportation charges. card (0800-952 5252) both pay a full one per cent, which should keep you in skin cream for a while. IN HER will, my late mother created a trust with a life interest in favour of my father, which means he is entitled en·ti·tle tr.v. en·ti·tled, en·ti·tling, en·ti·tles 1. To give a name or title to. 2. To furnish with a right or claim to something: to the trust's income during his lifetime. I am the trustee but I cannot find a safe investment such as a bank or building society account which caters for a trustee investment under a will trust. K.D.,Crosby I AM surprised no bank or building society will let you open an account. Perhaps they feel the sum involved does not make the legal responsibility of a trust account worthwhile. Bear in mind that, as well as having a duty to generate income for your father, you also have a responsibility to whoever will inherit To receive property according to the state laws of intestate succession from a decedent who has failed to execute a valid will, or, where the term is applied in a more general sense, to receive the property of a decedent by will. inherit v. the capital on his death. Putting every penny into an interest bearing account which offers no capital growth could lead to an accusation A formal criminal charge against a person alleged to have committed an offense punishable by law, which is presented before a court or a magistrate having jurisdiction to inquire into the alleged crime. of neglect. Consider seeking legal advice on this point, but my own suggestion is a spread of gilt edged stocks. They are safe, they generate interest, and some offer growth as well. I HAVE sold my house but am unable to complete the purchase of my new home for about three months. Is there anywhere I could invest pounds 200,000 for this period, with instant access?
