He is best known to Canadian audiences from his stint as the husband in the sitcom The Trouble With Tracy, and as a series regular on the sketch comedy series Bizarre. , an attorney for Miller Bros BROS Brothers BROS Benefits and Retirement Operations Section (King County, Washington) BROS Barnes and Richmond Operatic Society (London, UK) ., said a $661 million lawsuit, which says developers lied to the city about the road's safety, is without merit and that ``many of the statements in the lawsuit are false, unsupported by any facts and incomplete.'' Westlake Village attorney Edward Masry filed the suit Monday on behalf of a community activist and an environmental group against Miller Bros. and its partner, Operating Engineers Operating Engineers are tradepeople who operate machinery. There are two main types of workers that share this title and trade union affiliation (IUOE). The first group are workers who operate steam plants and boilers. . Masry had previously filed two other suits claiming the road's 12 percent grade would be unsafe, but withdrew both actions. ``It's not going to succeed in court and my clients will not be too polite to Mr. Masry and his clients in defense to his lawsuit,'' Weston said. ``It's irritating at this point, given his track record is willfully willfully adv. referring to doing something intentionally, purposefully and stubbornly. Examples: "He drove the car willfully into the crowd on the sidewalk." "She willfully left the dangerous substances on the property." (See: willful) poor in regards to Borchard Road.'' In response, Masry said the developers should file a motion to dismiss the suit if they feel it has no merit. ``They said our lawsuit was not worth a nanosecond (1) One billionth of a second. Used to measure the speed of logic and memory chips, a nanosecond can be visualized by converting it to distance. In one nanosecond, electricity travels approximately a foot in a wire. ,'' Masry said. ``Now they've spent 4 trillion nanoseconds on it. Stop talking and file a motion to dismiss.'' The road has been at the center of controversy since the City Council approved the extension of Borchard, one of two main arteries connecting the 2,350-home development with the rest of Newbury Park. Spurred by residents, the City Council ordered construction halted on the road, an action that prompted developers to file suit against the city. A judge subsequently lifted the stop-work order and ruled that construction could proceed. The City Council on Tuesday voted to appeal that ruling. Weston said Miller Bros. would be willing to dismiss its lawsuit against the city if ``all disputes regarding Dos Vientos ranch, including outside lawsuits'' are dismissed against the developers. Weston said he also would seek to have the city pay the developers' legal fees, which so far total about $500,000. |
