DISTRICT LOOKS TO GET LAND TRUSTEES WANT SCHOOL OPEN IN FALL OF 2005.

LANCASTER - High school trustees will consider beginning condemnation procedures to acquire land around the proposed Eastside High School Eastside High School or East Side High School can refer to:
  • Eastside High School (Gainesville, Florida)
  • Eastside High School (Covington, Georgia)
  • Eastside High School (Paterson, New Jersey)
  • Eastside High School (Taylors, South Carolina)
 for the building of roads and installing of utilities.

Antelope Valley Union High School District The Antelope Valley Union High School District (A.V.U.H.S.D.) is located in the Antelope Valley area of California, in northern Los Angeles County.

The district includes eight public high schools, one trade school, and two continuation high schools in the cities of Palmdale
 officials say they must commence eminent-domain proceedings now to have the school ready to open in the fall of 2005.

``It's a process one goes through in terms of the potential acquisition of property,'' Assistant Superintendent Assistant Superintendent, or Assistant Superintendent of Police (ASP), was a rank used by police forces in the British Empire. It was usually the lowest rank that could be held by a European officer, most of whom joined the police at this rank.  Jeff Foster said. ``These are right-of-way issues that we need for the building of the road on the north side of the property.''

Construction of the $100 million campus near 35th Street East and Avenue J-8 is scheduled to begin in 2005, and the schools will open in 2005 with freshmen only in portable classrooms.

The board will discuss the property condemnation at its meeting 7 p.m. Wednesday at the district office, 44811 Sierra Highway.

A representative from a neighboring homeowners group who opposes the project filed a lawsuit in January seeking to overturn the district's environmental study for the school.

Some trustees fear the legal challenge might delay construction. No court hearing has been set yet, and Foster declined to comment on the case.

The high school district wants to condemn nine strips of land, all on vacant properties.

``District staff and consultants have attempted to negotiate voluntary purchases, with mixed success. These efforts will continue, but in order to keep the project on schedule, the district must commence eminent domain eminent domain, the right of a government to force the owner of private property sell it if it is needed for a public use. The right is based on the doctrine that a sovereign state has dominion over all lands and buildings within its borders, which has its origins in  proceedings now in order for the district to meet its student housing needs,'' a district staff report said.

According to the report, public roads and utilities, including water and electricity, must be installed to serve the site. To facilitate these public improvements, it is necessary to acquire road, drainage, and utility easements EASEMENTS, estates. An easement is defined to be a liberty privilege or advantage, which one man may have in the lands of another, without profit; it may arise by deed or prescription. ``Nine properties have been identified as needed as needed prn. See prn order.  to provide the additional right of way and easement easement, in law, the right to use the land of another for a specified purpose, as distinguished from the right to possess that land. If the easement benefits the holder personally and is not associated with any land he owns, it is an easement in gross (e.g.  dedications necessary for the district to complete the project,'' the report said.
