Iacenda, 20, had one count of sexual assault dismissed on Jan. 6, after a Las Vegas judge ruled the district attorney withheld key evidence from a grand jury.

The district attorney's office has a five-year window to re-file the charge, but Iacenda's attorney received a letter Thursday stating the case was closed.

``We're just grateful that it's over,'' said Stan Hunterton, Iacenda's attorney. ``I think they made the right decision. It was a bad case.''

Iacenda was charged with sexual assault in September 1996, after a then-17-year-old former Hart student alleged he raped her in a Las Vegas hotel room two months earlier.

``It's kind of like, the system works . . . eventually,'' Hunterton said.

Iacenda's father, Andy, said Friday he intends to file a civil lawsuit against the family of the alleged victim.
