DISPUTE COULD PUSH BACK MCGRATH SCHOOL OPENING.

SANTA CLARITA - The opening of J. Michael McGrath Elementary school, planned for summer of 2003, could be delayed because of a tussle between two neighboring developers.

If the developers do not come to a solution by Sept. 10, the district will sue under eminent domain, law that allows public agency to take of land for the greater public good.

``We're ready to go, if it comes to that,'' Winger said. ``But, we want to get this resolved.''

The project's construction manager emphasized to the school board at its Aug. 13 meeting that contracts need to be awarded by Oct. 16 to enable them to complete the campus by the 2003-04 school year.

``We don't want to put off a whole year,'' Winger said. ``If you miss the opportunity to start a 180-day school year, the opportunity is blown off.''

In the event of a delay, the school would consider options including a staggered opening.

The district is looking to the two schools expected to open in 2003 - McGrath and Pico Canyon - to ease the overcrowding overcrowding
