Oraqix(TM) is in a gel format and provides pain relief without the discomfort of a needle for application. DENTSPLY has agreed to pay $2 million as a milestone payment upon submission of an Oraqix(TM) New Drug Application (NDA (Non Disclosure Agreement) An agreement signed between two parties that have to disclose confidential information to each other in order to do business. In general, the NDA states why the information is being divulged and stipulates that it cannot be used for any ) in the U.S., and Marketing Authorization Application (MAA MAA abbr. macroaggregated albumin )in Europe(this payment will be expensed in the fourth quarter of 2001, and is expected to be paid in the first quarter of 2002), an additional $18 million payment upon approval of both the NDA and MAA and future royalties on sales of the product. The $18 million payment is expected to be made during 2003 and includes a pre-paid royalty of $10 million. John C. DENTSPLY also announced that it expects to meet or exceed analysts' earnings estimates for the fourth quarter. These items include restructuring and other costs, primarily related to recent acquisitions, of approximately $12 million; a gain from the U.K. pension plan asset reversion received in October of $8.4 million; a gain on the insurance equipment settlement for the Maillefer fire of approximately $6.0 million; and a charge for the Oraqix(TM) payment of $2 million.
