The state Legislative Counsel issued an opinion at the request of state Sen. Richard Alarcon, D-Van Nuys, several days after the March 5 election, saying the proposition failed to meet the law's disclosure requirements.

Prior to the election - in response to concerns raised by VICA - Delgadillo's office determined the measure did comply with state law by spelling out in the ordinance A law, statute, or regulation enacted by a Municipal Corporation.

Also, Gaines noted that the Truth in Bonding Act does not provide very strong enforcement measures, so VICA also plans to ask local state legislators to strengthen the act.

`'This is really uncharted ground for all of us and we are hopeful of working out an agreement with VICA to adopt policies that will meet all the terms of the state law,'' Bower said.

`'We are confident we do meet state law, but want to make sure everyone is happy with it.''

Delgadillo hopes by working out the issue now, it will help the city in future bond measures, Bowers said.
