DEATH SPARKS ACTIONS DAMAGE CLAIMS FILED IN INMATE FATALITY.

A lawyer last week filed a $10 million claim with the county on behalf of the deceased inmate's 2-year-old daughter, just two days after a separate claim was filed on behalf of the inmate's mother, two brothers and 17-year-old son.

Jerry John Moreno, 33, died Jan. 12 at Henry Mayo Newhall Memorial Hospital in Valencia, two days after an altercation at the Castaic jail complex, operated by the Sheriff's Department.

According to court documents, Moreno suffered a large gash to the head and a small hole in his neck, as well as bruises to his torso and arms. He was hogtied and lying face down when he arrived at the hospital, with a blanket wrapped around his head, according to one of the claims.

Neither jail officials nor sheriff's homicide detectives have responded to repeated requests from the Daily News for information about Moreno's fatal injuries. However, the claim filed on behalf of four family members states deputies had to take control of Moreno after the inmate suffered ``what appeared to be a psychotic incident and began acting irrationally.''

The claim states that deputies shot Moreno three times with a stun gun stun gun, hand-held electronic device that produces a high-voltage pulse that can immobilize a person for several minutes with no permanent damage in most cases.  and fired pepper balls at him before tying his wrists and ankles and ``either deliberately or accidentally dropped decedent An individual who has died. Frances Campbell, the lawyer representing Moreno's daughter, filed the claim July 6. The child lives in Whittier with her mother, who was engaged to Moreno at the time of his death.

``This claim was filed because we've got a little 2-year-old girl without a father,'' Campbell said Friday in a telephone interview from her Los Angeles Los Angeles (lôs ăn`jələs, lŏs, ăn`jəlēz'), city (1990 pop. 3,485,398), seat of Los Angeles co., S Calif.; inc. 1850.  office. ``No matter how he died, I don't think it's correct or justifiable.''

Campbell said she expects the county to reject the claim within 90 days, which then clears the way for Moreno's daughter to file a wrongful death The taking of the life of an individual resulting from the willful or negligent act of another person or persons.

If a person is killed because of the wrongful conduct of a person or persons, the decedent's heirs and other beneficiaries may file a wrongful death action
 lawsuit against the Sheriff's Department.

The attorney who filed the claim on behalf of the other family members could not be reached Friday for comment.
