DDSI DISTRIBUTOR AMENDS LAWSUIT FILED IN DECEMBER 1992 TO RESCIND EXCLUSIVE DISTRIBUTION AGREEMENT

TORRANCE, Calif., April 22 /PRNewswire/ -- The lawsuit filed by two TESA Corp. shareholders in December 1992, has been amended to make TESA Corp. the plaintiff and further included Ron Waldorf and Charles Phillips of Drug Detection Systems Inc. (OTC: DGDT) as defendants in addition to DDSI.
DDSI has terminated the exclusive distribution agreement with TESA because of the lawsuit action as well as TESA's inability to perform under the terms of the agreement. "It is unfortunate that TESA didn't perform under the terms of the exclusive distribution agreement," said Waldorf, DDSI chairman. "However, DDSI, under its Director of Marketing, Arnie Kay, is developing its own dealer network for the marketing and distribution of the performance testing product line."
DDSI currently has three products, of which TESA was distributing only one -- the EM/1 Eye Observation System for law enforcement use. The EPS-100 Performance System is being sold through independent dealers and representatives. Since its introduction to the market in January, almost half of the U.S. geographic market is active with dealer and representative planning in place including sale and shipment of two systems to dealers. Neither the EM/1 nor the EPS-100 are products that are FDA regulated.
The InfraRed/Video ENG System is the third product and it is awaiting FDA listing approval. JEDMED Instrument Co. of St. Louis is the exclusive distributor and has received a high level of interest in the product and is anxiously awaiting FDA listing approval in order to move into high gear in its promotion and marketing.
DDSI again refutes all claims in this amended complaint as being without merit and is working toward a swift resolution of the matter, but only on a basis that is equitable to all DDSI shareholders.
