DAY IN SPORTS: MEDDERS LOSES HER ELIGIBILITY APPEAL.

Byline: Daily News

A Southern Section appeals committee has upheld the ineligibility of Oak Park senior guard Lyndsey Medders. Last week, Medders was ruled in violation of Southern Section by-law 216, which determines the criteria for change of residence after a player transfers.

``The committee sustained my decision that it was not a bona fide [Latin, In good faith.] Honest; genuine; actual; authentic; acting without the intention of defrauding.

A bona fide purchaser is one who purchases property for a valuable consideration that is inducement for entering into a contract and without suspicion of being
change of residence,'' Southern Section commissioner Jim Staunton said. ``By bona fide, we mean a family has totally vacated from the premises and not leaving clothes hanging there or having a family member still living there. While we understand the family's situation, it did not meet the criteria for a change in residence.''

Medders was a Daily News All-Area selection last season at Harvard-Westlake of Studio City and transferred to Oak Park for her senior season. Medders, who has accepted a scholarship to Iowa State, said her family lives in an Oak Park apartment and only her brother Brian, 18, lives in their Westlake Village home.

The appeals committee announced its decision Thursday after meeting with the Medders family at a hearing Wednesday. If the family chooses to pursue the appeals process, it would make its case to the state executive commissioner. The family could not be reached for comment.
