In the interview, when asked by Rather if there were any concerns about the upcoming 2008 presidential election and how that might fit into the prosecution and non-prosecution of cases, Davis tells Rather, " I think the big fear that was expressed was if Hillary Clinton wins the White House -- this whole show goes away, and Guantanamo is shut down." Davis continued to say, "So, there's a distrust of the military. And you've got political involvement. What I've seen in this process is that if you combine -- ya know, excessive -- arrogance with excessive ignorance -- you wind up with six years later with -- one guilty plea done." The episode then leads into a larger discussion about Habeas Corpus and whether or not the detainees at Guantanamo have the right to challenge their detention. Joining Dan Rather in this discussion are Neil Katyal, a law professor at Georgetown University who successfully argued a Supreme Court case three years ago on behalf of a Guantanamo detainee and Andrew McBride, a lawyer who worked at the Justice Department and filed a brief in support of the government's position in this most recent case.
