DALLAS-BASED GOLDEN FRIED CHICKEN FILES SUIT IN FEDERAL COURT AGAINST KFC CLAIMING TRADEMARK INFRINGEMENT OVER NEW ROTISSERIE MENU ITEM

 DALLAS, Sept. 23 /PRNewswire/ -- Golden Franchising Corporation, the Dallas-based franchisor of Golden Fried Chicken restaurants, announced today that it has filed suit in federal court against Kentucky Fried Chicken alleging that KFC's new Rotisserie Gold chicken infringes on Golden Fried Chicken's trademarked Golden Rotisserie(TM) menu item.
 The suit, which was filed in U.S. District Court in Dallas, seeks a preliminary and permanent injunction to stop KFC from using the name and trademark for its rotisserie product. The suit also seeks damages.
 In its suit, Golden Fried Chicken claims that KFC's Rotisserie Gold will cause confusion with Golden Fried Chicken's Golden Rotisserie(TM) among consumers because it is used to denominate a product virtually identical to that offered by GFC and that it infringes on GFC's Golden Rotisserie(TM) mark because it contains the same words and uses the same color scheme. The suit goes on to say that KFC's actions have caused, and unless restrained, will continue to cause irreparable harm, damage and injury to Golden Fried Chicken.
 All Golden Fried Chicken restaurants are recognized by their traditional gold roofs and gold and red signage.
 Golden Fried Chicken Executive Vice President Victor Erwin said that prior to KFC's introduction of the new menu item, Golden Fried Chicken twice informed KFC that there was a likelihood of confusion between the two trademarks.
 "There is no doubt that they have violated our trademark," said Erwin. "When they moved forward with their introduction, we had no choice but to defend our interests against this much larger competitor."
 Golden Fried Chicken, founded in 1967, has 90 restaurants located throughout Texas, Oklahoma, Arkansas and Mexico. Golden Fried Chicken also operates Golden Chick restaurant in Richardson, Texas, which features the Golden Rotisserie(TM) chicken.
