It is unknown whether DBI will appeal the ruling to a higher court. Randall C. Fowler, Identix chairman and chief executive officer, who was also named as a defendant in the suit, commented: "We expected this decision all along. We are delighted that the court recognized that our product is very different than what is described in DBI's patent, and has disposed of the case." DBI has also alleged that Identix's TP-900 -- the predecessor to the TP-600 and no longer on the market -- of infringement. That issue was not addressed by the parties' summary judgment motions. Fowler continues to believe that, like the claims against the TP-600, the claims against the TP-900 are unfounded, saying: "The way the court interpreted the meaning of DBI's patent strengthens our belief that DBI's patent is very different from the TP-600 and TP-900."
