Court grants Identix's summary judgment motion and denies Digital Biometrics' motion.


SUNNYVALE, Calif.--(BUSINESS WIRE)--Aug. 26, 1996--Identix Inc. (ASE (Adaptive Server Enterprise) A relational DBMS from Sybase that runs on Windows NT/2000, Linux and a variety of Unix platforms. ASE is a comprehensive and robust data management product with a long history dating back to the late 1980s. :IDX (IDX Systems Corporation, South Burlington, VT, www.idx.com) One of the largest health care information systems companies in the country, acquired in 2006 by GE Healthcare (www.gehealthcare.com), a unit of the General Electric Company. ) Monday announced that a federal court in California has ruled that the company's TouchPrint-600 product, used by law enforcement agencies A law enforcement agency (LEA) is a term used to describe any agency which enforces the law. This may be a local or state police, federal agencies such as the Federal Bureau of Investigation (FBI) or the Drug Enforcement Administration (DEA).  to electronically record fingerprint image data, does not infringe a patent held by a competitor, Digital Biometrics Inc. The court found that there were no factual questions to resolve, and that a jury trial is therefore unnecessary. The court further rejected DBI's motion to enter a judgment of infringement as a matter of law. The ruling disposes of DBI's case against Identix's TP-600 product. It is unknown whether DBI will appeal the ruling to a higher court.

Randall C. Fowler, Identix chairman and chief executive officer, who was also named as a defendant in the suit, commented: "We expected this decision all along. We are delighted that the court recognized that our product is very different than what is described in DBI's patent, and has disposed of the case."

DBI has also alleged that Identix's TP-900 -- the predecessor to the TP-600 and no longer on the market -- of infringement. That issue was not addressed by the parties' summary judgment motions.

Fowler continues to believe that, like the claims against the TP-600, the claims against the TP-900 are unfounded, saying: "The way the court interpreted the meaning of DBI's patent strengthens our belief that DBI's patent is very different from the TP-600 and TP-900."

Identix plans to file a motion for summary judgment motion for summary judgment n. a written request for a judgment in the moving party's favor before a lawsuit goes to trial and based on recorded (testimony outside court) affidavits (or declarations under penalty of perjury), depositions, admissions of fact, answers  against DBI with regards to the TP-900 product. If Identix's motion is granted, the entire case will be disposed of subject to appeal by DBI.
