For the second time since September, a Federal Judge denied Adidas' subsidiary TaylorMade's attempt to dismiss Pixl Golf's claims against TaylorMade. The Orders on September 27, 2002, and December 13, 2002, ruled that Pixl Golf's claims of fraud, misappropriation misappropriation n. the intentional, illegal use of the property or funds of another person for one's own use or other unauthorized purpose, particularly by a public official, a trustee of a trust, an executor or administrator of a dead person's estate, or by any  of confidential information Noun 1. confidential information - an indication of potential opportunity; "he got a tip on the stock market"; "a good lead for a job"

Bob Zider, Pixl's Chairman, said, "Obviously, we are very pleased, but not surprised by this outcome. It has taken over two years to reach this point and now we look forward to a Jury decision. This case is about TaylorMade stealing our technology after working closely with us for over 15 months. We think this is a good time for a Jury trial, given how many regular folks have seen their 401K's destroyed by big corporations' greed and dishonesty. Having taken a chance that Pixl would either never find out about what TaylorMade did, or we would not be willing or able to go the distance in this lawsuit, TaylorMade must now accept the consequences of its actions."

Pixl anticipates a trial date will be set soon for sometime in the spring/summer of this year.

Pixl President, Art Chou, said, "This decision is very important to Pixl and our customers. We are growing very fast in a stale golf club market because our customers see the value in our technology and find their customers, the golfers, very enthusiastic to Pixl's Clubface club·face

It is very important for Pixl and our customers, who invest their valuable marketing and sales resources, that our exclusive, patented Pixl technology be protected."
