Court Stipulation Signed That Protects Copyright of J.R.R. Tolkien's The Lord of the Rings.

Based on a complaint filed by The Estate of J.R.R. Tolkien, author of The Lord of the Rings, Judge Barbara J. Rothstein has signed a stipulated order requiring Michael W. Perry Michael W. Perry is the co-host, along with Larry Price, of the conservative Perry & Price show on KSSK-FM in Honolulu, Hawaii. He also hosts the Hawaiian Moving Company television newsmagazine on KGMB in Honolulu.  to stop all advertising, promotion, distribution, selling or other dissemination of The Lord of the Rings Diary, A Chronology of J.R.R. Tolkien's Best-Selling Epic, pending the outcome of the case. The would-be publisher of the book is Inkling in·kling

 Cathleen Blackburn, the Estate's representative, the basis for the dispute is that The Lord of the Rings Diary violates two of the rights exclusively reserved to copyright owners: the reproduction right and the right to make derivative copies. She said, "Simply stated, re-telling the story in chronological order violates copyright. The reproduction right is violated because Perry's Diary is substantially similar to The Lord of the Rings. It takes a substantial amount of protectable expression from Tolkien's book without the consent of the Estate. The Diary also infringes the Estate's reproduction right in the two published versions of a chronology of the events in The Lord of the Rings authored by Tolkien himself. Those chronologies represent Professor Tolkien's own choices as to how much to abbreviate for his readers and how much to leave for full exploration of his narrative text."
