Court Ruling Favors Valeo IP.

, Minn. -- In a decision released May 5, 2005, Federal Judge James Robart stated that certain allegations made by Data Depth Corporation against Valeo Intellectual Property, Inc. were "hyperbole" and the result of "mistaken impressions". The court further found that Data Depth had failed to show that Valeo IP had violated any copyright, patent or other intellectual property rights of Data Depth.

The court also denied Valeo IP's motion for preliminary injunction A temporary order made by a court at the request of one party that prevents the other party from pursuing a particular course of conduct until the conclusion of a trial on the merits.

A preliminary injunction is regarded as extraordinary relief.
 because it found insufficient harm to Valeo IP's business and because a jury could find that Valeo IP's failure to use the Data Depth trademark in connection with metatags used with on-line content was a breach of the agreement between the two companies. The parties dispute whether the contract required such usage. The court also found that Data Depth was not likely to succeed at proving its allegations that other actions by Valeo IP materially breached the agreement.
