The earlier release reported that on Aug. 12, 1997, the Court certified See certification. as a class action a lawsuit against Great Western concerning Great Western's conduct in reconveying deeds of trust after the underlying residential mortgage loans had been paid off. In correction of the earlier erroneous release, the Court did not certify cer·ti·fy v. cer·ti·fied, cer·ti·fy·ing, cer·ti·fies v.tr. 1. a. To confirm formally as true, accurate, or genuine. b. a class at the Aug. 12, 1997, hearing. Rather, the Court ordered additional briefing and continued the proceedings until March 23, 1998. At the Aug. 12, 1997, class certification hearing, plaintiffs had sought to certify two classes: first, a class of persons who, within a certain time frame, paid off loans at Great Western whereby their deeds of trust were not reconveyed "according to according to prep. 1. As stated or indicated by; on the authority of: according to historians. 2. In keeping with: according to instructions. 3. law"; and second, a class of persons who, within a certain time period, bought residential real property from Great Western's former borrowers, where such real property was encumbered Encumbered A property owned by one party on which a second party reserves the right to make a valid claim, e.g., a bank's holding of a home mortgage encumbers property. by deeds of trust that were allegedly not reconveyed "according to law." The Court denied certification of the latter proposed class on Aug. 12, 1997. As to the first proposed class, the Court ordered plaintiffs to redefine Verb 1. redefine - give a new or different definition to; "She redefined his duties" define, delimit, delimitate, delineate, specify - determine the essential quality of 2. their approach, finding that a definition based on whether Great Western acted "according to law" was ambiguous and unworkable. Revised class definitions will be discussed and ruled upon by the Court in March 1998. The Court also questioned whether members of the proposed class could be identified in a cost effective manner and gave plaintiffs until Jan. 26, 1998, to file a list of alleged class members, along with supporting evidence showing plaintiffs' reasons for including such persons within their class and the system by which such persons were identified.
