Court Orders Correction to Prior News Release.


LOS ANGELES--(BUSINESS WIRE)--Sept. 30, 1997--Los Angeles County Superior Court Commissioner Bruce Mitchell Bruce Mitchell may be:

 ordered the parties in Baron v. Great Western Bank (Case No. BC 121153) to issue an amended news release under the auspices of the Court to correct an earlier, erroneous erroneous adj. 1) in error, wrong. 2) not according to established law, particularly in a legal decision or court ruling.  release issued by plaintiffs' counsel.

The earlier release reported that on Aug. 12, 1997, the Court certified See certification.  as a class action a lawsuit against Great Western concerning Great Western's conduct in reconveying deeds of trust after the underlying residential mortgage loans had been paid off.

In correction of the earlier erroneous release, the Court did not certify cer·ti·fy

 their approach, finding that a definition based on whether Great Western acted "according to law" was ambiguous and unworkable. Revised class definitions will be discussed and ruled upon by the Court in March 1998.

The Court also questioned whether members of the proposed class could be identified in a cost effective manner and gave plaintiffs until Jan. 26, 1998, to file a list of alleged class members, along with supporting evidence showing plaintiffs' reasons for including such persons within their class and the system by which such persons were identified.
