Court Dismisses Short Sellers' Civil Suit Against Intelli-Check.

 and D&K Charitable Foundation against Intelli-Check and four current and former officers and directors of the company.

As previously disclosed, the plaintiffs, who were short-sellers of Intelli-Check stock, brought suit in October 2001, alleging violations of federal securities laws. Originally, the plaintiffs proposed a class action suit, but they amended their lawsuit in November 2001 into an individual action on behalf of the three individual plaintiffs. On July 26, 2002, the company filed a motion to dismiss the lawsuit, which was granted on July 30, 2003. The Court's decision allows the plaintiffs to move to file an amended complaint amended complaint n. what results when the party suing (plaintiff or petitioner) changes the complaint he/she has filed. It must be in writing, and can be done before the complaint is served on any defendant, by agreement between the parties (usually their lawyers),  within 30 days. The Court stated that, "If plaintiffs choose to timely move for leave to file (an) amended complaint, the Court will then consider whether the amendments would be futile."
