:COMM), applauded yesterday's decision by the Public Utilities Commission of Ohio The Public Utilities Commission of Ohio (PUCO) is an agency of Federal State of Ohio that is charged with the regulation of utility service providers such as those of electricity, natural gas, and telecommunications as well as railroad safety and intrastate hazardous  (PUCO) granting CoreComm's complaint alleging that Ameritech Ohio has illegally provided inadequate, unjust, and unreasonable wholesale service while also engaging in an aggressive "winback" marketing program directed at newly acquired customers of CoreComm, thereby giving Ameritech an unreasonable and undue competitive advantage to the detriment of competition in Ohio.

After considering the extensive evidence presented by CoreComm and other parties, the PUCO concurred with CoreComm's allegations that Ameritech's service to CoreComm and other competitive local exchange carriers (CLECs) is inadequate.

Citing concerns that these service problems "directly affect the CLECs' ability to effectively compete with Ameritech" and that "Ameritech will derive an unfair competitive advantage" until these service inadequacies are resolved, the PUCO ordered Ameritech to refrain from engaging in "winback" marketing efforts aimed at new customers of CoreComm and other CLECs for a period of 30 days following the successful transfer of the customer to the competitive carrier.

"It's simply unfathomable that Ameritech has been unable to develop adequate wholesale systems and ordering procedures in the six years that have passed since the Telecommunications Act was adopted by Congress. We're hopeful that the PUCO's action will force Ameritech to improve the quality of its services, but we're not overly optimistic, given Ameritech's abysmal track record."

The prohibition on Ameritech's "winback" marketing will remain in place until Ameritech demonstrates to the PUCO that its wholesale service inadequacies have been fully resolved. The PUCO had previously imposed the same restriction in a temporary order dated April 11, 2002, which Ameritech tried unsuccessfully to get overturned by the Ohio Supreme Court in an appeal that was denied.
