Columnist's criticism off mark; city of Regina reviewing its tendering process. (Letters to the Editor).


Further to your interest in the IPSCO tender, I am writing to provide you with the status of city council's considerations on this issue.

On Monday, September, 23rd, city council considered the attached report from the city manager that reviews, in detail, the tender for this project. Council, like all other Regina citizens, wanted this contract to go to IPSCO. Unfortunately, the tendering laws did not permit us to do this without a substantial law suit that would result in a significant cost for the taxpayers of the city of Regina.

As a result of this issue, we have discussed the tendering process and adopted a motion to review the entire purchasing process Purchasing Purchasing is the formal process of buying goods and services.

The Purchasing Process can vary from one organization to another but there are some key elements that are common throughout

The process usually starts with a 'Demand' or requirements
, including RFP's and tendering, through a committee and independent consultant. This should help us identify any areas for improvement in the city's practices.

Conclusion

At the instruction of the executive committee, your administration provides this report to address questions and concerns raised in respect to the award of the contract for the Buffalo Pound pipe to Northwest. It includes consideration to the Canada/Saskatchewan Infrastructure Program, the implications of canceling the project, and/or the contract to Northwest and any subsequent decisions that might result in respect to the tender or award of the contract.

The report also necessarily addresses city council's procedure bylaw by·law

The body of officers, taken collectively, belonging to a city, who are appointed to manage its affairs and defend its interests.  Act in respect to recommendations and amendments. That bylaw specifically prohibits the reconsideration of a contract if that would interfere with an obligation imposed by previous decision of city council. That would clearly be the case in this instance. While there are procedures open to city council to amend its procedure bylaw, they cannot be recommended by your administration.

Your administration cannot recommend any considerations by city council to cancel the contract, retender or award the contract to IPSCO. There are very substantial issues of law, governance integrity and principles of open and fair competition and process at stake. As regrettable as the decision of city council may seem to those who favor local enterprise, investment and jobs, such considerations, if applicable at all, must be addressed before a public tendering process. The essence of a public tendering process is to provide an open and fair competition to all parties without favor and to award the contract to the low qualified bid without consideration to any bidder that does not submit a valid tender. To do otherwise exposes the city to both litigation An action brought in court to enforce a particular right. The act or process of bringing a lawsuit in and of itself; a judicial contest; any dispute.

When a person begins a civil lawsuit, the person enters into a process called litigation.
 for damages by the compliant bidder and exposes the integrity and transparency of the decision making body to questions and disrepute dis·re·pute
