Coke and Pernod announced in a joint press release that the new agreement is intended to respond to the concerns of French competition authorities by excluding Coke from distributing Orangina in French restaurants, bars and hotels for 10 years. Coke will be allowed to sell the orange-flavored drink in French stores for customers to take home, which makes up some 80 percent of the market for the drink in that country. The restriction does not apply to Coke's rights to sell Orangina in other countries.

Coke first agreed to buy Orangina in December 1997 to expand its line of beverages and build sales in Europe. Last month, France's highest administrative court rejected Coke's appeal to overturn a government decision to block the purchase. Coke wants to buy Orangina and use the popular European European

And, apparently Coke's chief rival still has concerns. The head of PepsiCo France last week was quoted in a newspaper as saying Coke's new offer does not settle deep competition concerns. "This new offer is a pure window-dressing which does not resolve the question of competition in France," PepsiCo France Managing Director Charles Bouaziz said in an interview with Les Echos newspaper. He said he was greatly surprised by Coke's offer, as it was only 6 percent lower than the initial bid. Also, as the new agreement excludes nearly 25 percent of Orangina's sales volume, made in the non-home sector, making up more than half the brand's profits.
