) has filed for worldwide patent protection of its proprietary coal enhancement process and that it has received encouraging news in this regard. Patent protection has been sought through the World Intellectual Property Organization through the Patent Cooperation Treaty The Patent Cooperation Treaty (PCT) is an international patent law treaty, concluded in 1970. ) has issued a report based on the search of the relevant prior art and the reasoned opinion in that report indicates that the proprietary coal enhancement process is patentable as filed. As indicated in the report, "there is no reasonable basis to believe that the skilled one in the art could arrive at the subject matter of the claims without exercising inventive skill. Therefore, the subject matter of claims (1-18) is considered to be novel, involve inventive step and be industrially applicable under PCT Article 33(2)-(4)."

While the patent office of each country has the right and the authority to make the final decision as to the patentability of the process, such a finding is encouraging regarding the prospects for issuance of patents in many countries that have ratified the PCT.
