Class-action suit targets AERT over ChoiceDek.


A group of law firms has filed a class-action lawsuit against Advanced Environmental Recycling Technologies Inc. of Springdale and distributors Lowe's and Weyerhaeuser over AERT's ChoiceDek product, and an AERT AERT Advanced Environmental Recycling Technologies, Inc

 executive called the lawsuit "scurrilous" and "reckless."

In statement, AERT CEO (1) (Chief Executive Officer) The highest individual in command of an organization. Typically the president of the company, the CEO reports to the Chairman of the Board.  Joe Brooks said he was "blindsided" by the news reports of the lawsuit, which hit the wires before his company had been served. Brooks disputed the notion AERT uses contaminated plastics in its final product.

The law firms filed the lawsuit in the Western District of Washington on behalf of plaintiffs Stanley and Betty Pelletz of Longboat Key, Fla. The firms are Cohen cohen

The lawsuit, which seeks to include all customers who have purchased ChoiceDek, alleges AERT gave misleading statements about the moisture resistant and low-maintenance qualities of the composite material made from recycled plastic and wood fibers.

The complaint alleges that a defective manufacturing process by AERT using plastics contaminated by food waste causes "black spots" of mold and mildew resulting in "time-consuming, labor intensive and expensive" maintenance.

Brooks said the recycled plastics in AERT products were "cleaned, heat sterilized, and blended and reformulated into specific/desired ranges for physical properties."
