The complaint alleges that "port charges" typically increase the CCCL advertised cruise fare by over $75 per person; that CCCL has led the public to believe that "port charges", which are billed separately and collected by them as a conduit, are costs charged to CCCL by governmental authorities both in the U.S. and abroad for the use of their ports of call; and that "port charges" are then passed through to the passengers on a pro rata [Latin, Proportionately.] A phrase that describes a division made according to a certain rate, percentage, or share. Plaintiff in this action seeks to recover damages on behalf of all persons who traveled on any of the defendant's cruises within the last four years and paid "port charges" levied by CCCL. Each year, CCCL carries over 50,000 U.S. originated cruise passengers. According to figures obtained by plaintiff's attorneys, CCCL has, and continues to collect well over $3.75 million per year in "port charges". The lawsuit seeks nationwide class action status on behalf of all passengers who traveled on the defendant's cruises within the last four years and paid "port charges" levied by the line. The class action complaint filed asserts claims for conversion, restitution and unfair and deceptive business practices in violation of Florida law.
