Class Counsel Announce Filing Of Class Action Lawsuit Charging International Security Services Corporation With Refusing To Pay Current And Former Workers For Required Pre-Shift Overtime Work.

SAN FRANCISCO -- Charging the global security firm with failure to pay overtime wages in violation of federal and state labor laws, current and former employees of Inter-Con Security Services Inc., filed a class action lawsuit today in U.S. District Court in San Francisco. The suit, Adams et al. v. Inter-Con Security Services, Inc., was filed by attorneys from Lieff Cabraser Heimann & Bernstein, LLP, Altshuler, Berzon, Nussbaum, Rubin & Demain, and Liberty Law Office on behalf of Inter-Con security guards throughout California.

Inter-Con employs more than 25,000 workers globally to provide "a full range of physical security services," including security guard services at Kaiser Permanente hospitals, other healthcare facilities, government buildings, and other sites. The proposed class of plaintiffs includes approximately two thousand security guards in California, and possibly many more throughout the United States could be included. Inter-Con guards protect healthcare workers, patients, and their families at Kaiser's 230 hospitals and other buildings nationwide, in addition to protecting others in various sites throughout the country.

The complaint charges that Inter-Con unlawfully requires its security guards to attend fifteen-minute security briefings prior to each eight-hour shift, without paying them.

"While the security guards understand the importance of being informed and prepared for their duties, it is unfair and illegal for Inter-Con to expect the guards to work for free," said Barbara Chisholm, an attorney with Altshuler, Berzon, Nussbaum, Rubin & Demain. The overtime pay withheld from employees amounts to approximately $1,000 per year, per employee. Given the low wages in the security services industry, these lost wages constitute a substantial burden on workers.

"These security guards work hard to protect doctors, nurses, patients, civil servants, and other residents of California and the United States," said Jahan Sagafi, an attorney with Lieff, Cabraser, Heimann & Bernstein. "Unfortunately, Inter-Con is depriving them of overtime pay these security guards have earned, in violation of federal and California law."

Plaintiff Roy Adams has worked as a security guard protecting the South San Francisco Kaiser hospital since June 2004. "I'm bringing this suit to ensure that my coworkers and I get paid properly for all the work we do."

"I've been in security and law enforcement for many years, and I like knowing that I'm helping protect my neighbors. But we can't afford to work for free," said Adams.

The plaintiffs are asking the federal court to issue an injunction requiring Inter-Con to properly pay overtime wages for all hours worked, and they are seeking compensation for all current and former employees who were denied overtime pay in California.
