The Public Foundation "Civil Initiative on Internet Policy" expressed its concerns over plans of Kyrgyz Patent Service to assume control over registration of domain names in kg. zone. Control of websites by government agencies in kg. zone poses a threat to violation of fundamental human rights and freedoms, said Tattuu Mambetalieva, head of the Public Foundation in interview for AKIpress."Re-delegation of functions on administration of domain names in kg. zone will not prevent violation of rights of owners of trade marks and brands," she said. Besides, there is effective mechanisms for settlement of disputes over domain names, rules and additional rules, a number of administrative tribunals administering consideration of any disputes like WIPO Arbitration and Mediation Center, National Arbitration Forum, CPR, etc. Fight against violation of rights of owners of trademarks is formalized in effective legislation, Tattuu Mambetalieva added, and cited the Law of the Kyrgyz Republic on Trademarks, Brands and Names of Places of Origin of Goods that define unsanctioned use of a trademark in Internet network as violation of the right of the trademark owner.Since 1997 Internet provider AsiaInfo is an official domain register of the 1st .KG level. KG abbreviation is a a code of the Kyrgyz Republic, according to the International Standard ISO-3166. Domain registration is realized through the names data base (NDB), which web representation is located on the www.domain.kg address. NDB is represented in two languages -- Russian and English. Domain names with an .kg, .com, .org, .net.kg endings are subject to registration. Domain names registration is realized in accordance with the hosting order and domain registration. Change of administrator or re-delegation is a special procedure set by Internet Assigned Numbers Authority that will require not only consent of AsiaInfo, but also opinion of the entire Internet community of the country.Re-delegation of the function of administration of domain names in kg.zone from AsiaInfo to Kyrgyzpatent is not appropriate, Tattuu Mambetalieva concluded.The Public Foundation "Civil Initiative on Internet Policy" is a nonprofit non-governmental organization (NGO) which was established in 2001. Representatives of key ICT players, legal experts in ICT sector, technical experts initiated establishment of the organization.
