Officer's Decision that was released today in the California Public Utilities Commission's (CPUC) investigation. In addition, Cingular is shocked that the CPUC Press Release today mischaracterizes the decision as an action by the Commission. In fact, it is not the order of the CPUC - it is merely the Presiding Officer's Decision, which can be appealed by either party to the Commission. Cingular only received the proposed decision within the last hour, and we are therefore unable to respond to it in its entirety but we will do so after we have had an opportunity to analyze the entire proposed decision. Cingular is deeply concerned that the decision may have been motivated by other intentions rather than to address any actual improprieties in any Cingular practices. It is noteworthy in that respect that the Decision goes to the unsupportable and outrageous extreme of recommending that Cingular be ordered to comply with CPUC rules that do not even exist yet. We stand by our commitment to providing our millions of California customers with top-notch, quality service. Furthermore, our business practices always have been and continue to be customer-focused, lawful Licit; legally warranted or authorized. The terms lawful and legal differ in that the former contemplates the substance of law, whereas the latter alludes to the form of law. A lawful act is authorized, sanctioned, or not forbidden by law. and fair. Cingular intends to appeal this preliminary decision and to take all steps necessary to try to ensure that there is a full and fair consideration of the facts under appropriate legal standards. Cingular has already requested the opportunity to have oral argument before all five CPUC commissioners, and continues to believe that it should be given the opportunity to argue its case to the Commissioners. |
